Were you given possession of a flat where necessary amenities & facilities were not provided by the developers?

You don't know how to face the builder and get all those essential amenities & facilities installed/commissioned by the developers?

Flat buyers of the Palladium Grand shows you the way forward.  Palladium Grand is a residential complex located in Dhanori area of the Pune City. Palladium Grand comprises of 140 units. Possession of these units were given in late 2008 and/or early 2009. M/s. Palladium Properties (joint venture of M/s. Raojee Constructions, M/s. Shreyas Shelters) are the developers of the project and Mr. Shirish Dasnurkar is the architect of the project.


Soon, flat owners realized that developers have not provided many of the essential amenities and services such as drinking water, 24X7 water supply, rain water harvesting, solar heated water, vermi-composting plant, open spaces etc.

However, one of the developer being the local person, flat owners were afraid to ask for these facilities and amenities, majority of which are mandated through the commencement certificates. For years, flat owners pleaded (orally and in writing) to the developers to provide these facilities and services. However, developers never paid attention to these requests and pleas.

Fed up with arrogance and negligent attitude of the developers, flat owners muscled courage in late 2013, and came on the streets of Dhanori. Since then these brave flat-owners adopted several strategies and approaches to highlight their problems and bring to the notice of law enforcement and civic authorities. What all they did so far, do you want to know?
  1. wrote several letters to developers at regular intervals demanding fulfilling the promises.
  2. social media campaign through blog site (helppalladiumgrand.blogspot.in), facebook, twitter, WhatsApp, etc.
  3. Representation to elected officers such as Members of Legislative Assembly (MLA), letters to Chief Minister and representation to the Prime Minister's office.
  4. Civil Suit for not providing water as promised as pledged through Affidavit and failure to provide other facilties
  5. Criminal suit for failing to provide water as pledged to the PMC through an affidavit.
  6. Consumer cases (85 individual cases) for failing to provide facilities, services and amenities as promised, and 
  7. Representations to civil servants and government officials such as PMC Commissioner, etc.
  8. Peaceful protests to highlight the problems and generate mass support.

These consistent efforts of over 2 years is now resulting into outcomes that all of these flat-owners were dreaming for over the years. Through these blog series "Magical Powers of Awakened Flat Buyers" we will share one of the developing success story.  Today's story is that of the - RAIN WATER HARVESTING.


Civic authorities when issue commencement certificate, it mandates that developer must provide functional rainwater harvesting system. This condition was part of the commencement certificate issued to M/s. Palladium Properties, developers of the Palladium Grand Complex. However, developers ignored this mandatory compliance and never created rainwater harvesting system.

As an outcome of sustained efforts the Commissioner of the Pune Municipal Corporation (PMC) was left with no choice but to form the one-person committee under the chairmanship of Additional Commissioner, PMC. This committee after verifying the facts on ground, opined that developers have failed to provide the rainwater harvesting system, and further ordered developers to put in place, a functional rainwater harvesting system by July 15, 2016.



This is a great moral and factual victory for the Palladium Grand flat owners. Finally, after a period of grumbling, developers started creating rainwater harvesting system in 2nd week of July 2016. At the time of publishing this blog - work is still under progress at a snail speed. However, with the morale boost, flat-owners and residents are vigilant this time. They are steadfast in their resolve to ensure that developers create this much needed and essential infrastructure to the best of their satisfaction and as required by the rules and standards in place.

Well, this just a beginning of series of small and big victories that are lined up for the flat-owners of Palladium Grand. This is just a trailer of magical powers of awakened flat buyers. Picture to abhi baki hai!!!

PRESS CONFERENCE TO EXPOSE IRREGULARITIES AND FRAUDULENT ACTS BY THE DEVELOPERS / BUILDERS OF PALLADIUM GRAND, DHANORI, PUNE







 Last week Akhil Bharatiya Grahak Panchayat held a press conference to expose the irregularities and fraudulent activities by 40 real estate builders in Pune. Palladium Grand complex located at the S.No. 17/1A/2, Dhanori was one of the 40 projects where in promoter(s)/builder(s) had engaged in the fraudulent activities.

Flat-owners of the Palladium Grand have made consistent efforts for over 8 years to bring these frauds, irregularities and deficiencies by the builder(s)/promoter(s) to the notice of relevant authorities. These consistent efforts have fructified now into authorities, especially the Pune Municipal Corporation accepting some of these irregularities, deficiencies and fraudulent activities.

Having been satisfied Hon. Commissioner Shri. Kunal Kumar ordered detailed investigation/hearings to be headed by Additional Commissioner Ms. Prerna Deshbratar.

Attached is the detailed press note highlighting irregularities, deficiencies and fraudulent activities by the promoter(s)/builder(s) of this complex. Also included are the outcomes of the early investigation(s) by the PMC authorities. This approach of pursuing the grievances with PMC has been path-breaking in its mechanism and results, and thus opens the opportunity for other housing societies within the jurisdiction of PMC.

PMC Commissioner order inquiery into irregularities by builders at Palladium Grand

PMC Commissioner, Mr. Kunal Kumar ordered an inquiry into the irregularities and non-compliance committed by developers and builders of Palladium Grand, a residential complex located in Dhanori area of Pune.

A delegation of 35 strong flat-owners met PMC Commissioner Mr. Kunal Kumar on Monday 28th March 2016 at his office. Mr. Kumar gave patient hearing to the grievances of the flat-owners.


He assured that inquiry will be completed in 15 days period by the Senior most Associate Commissioner of the PMC.

He has also ordered the officers to stop the existing projects of the developers / builders, until such time all the incomplete facilities are provided by them. 

He further cautioned officers of the City Engineers office to initiate strict action as per the law and ensure that developers / builders are complying with the conditions of the commencement certificates. 

Flat-owners are appreciative of the proactive response by Mr. Kunal Kumar, PMC Commissioner.

STORY OF CONNECTING ROAD GET EVEN MORE COMPLEX, INTERESTING, HILARIOUS AND FRUSTRATING

  • WE TOLD PMC THAT BUILDERS HAVE NOT PROVIDED CONNECTING ROAD. 

  • PMC OFFICERS NEITHER DID NOT BOTHER TO READ WHAT WE WROTE, NOR THEY CALLED US TO VERIFY WHAT EXACTLY IS THE PROBLEM. 

  • THEY SIMPLY CLOSE POT HOLES IN THE MOST IRRATIONAL WAY. IN DOING SO, THEY WASTE NATIONAL RESOURCES ENSURING THAT CITIZENS FRUSTRATE FURTHER MORE. 

  • WILL PMC LISTEN TO THE CITIZENRY?

     

    On February 1, 2016 we wrote a blog titled "PMC IS JUST NOT LISTENING & RESPONDING: Part 3" highlighting the fact that Builders / Developers have failed to provide the connecting road from the entrance of the Palladium Grand complex till the PMC Main Road.


    We were surprised that within an hours time PMC tweeted to say that they have registered our grievance, and it has been allotted no T102.  We appreciated this prompt action on the part of the PMC, especially the PMC Commissioner's office.

     This road was never developed in first place. It was all gravel and dirt. Now PMC just added three patches of tar in the middle of it, making it more dangerous for drivers. Amazing way to fixing responsibility on the developers / builders? Is PMC working for citizens or builders?

    On February 4, 2016 we were shocked yet surprised, angered yet laughing at what PMC did. They came and filled the pot holes on the road that never existed (or rather we should be specific in stating which was never laid with concrete or tar. So it looked like this.

    The road became worst than what it was till date. At least it was completely dirt road till date. Now it is neither or dirt or that of tar. Already two scooter riders have skidded because of uneven surface due to the tarred patches.

    It seems PMC is in hurry of closing all the complaints raised by Palladium Grand residents! For whose benefit, for saving your wrong deeds? or for supporting builders? or for crushing the voice of the citizens?

    PMC was also fast enough to close the grievance T102.  In last 3 days PMC officers suddenly closed down all the complaints raised by Palladium Grand residents, many even looking into the contents and context of these complaints.

    We are speechless, and shocked with this ruthless and irrational approach of PMC officers? It raises many doubts?

    WHY DID PMC NOT ASKED QUESTIONS TO BUILDER / DEVELOPERS?

    WHY PMC IS DOING SOMETHING WHICH BUILDER SHOULD HAVE DONE PRIOR TO SEEKING THE OCCUPANCY CERTIFICATE FOR THE COMPLEX?

    WHY DID PMC OFFICERS DID NOT VISIT THE PALLADIUM GRAND COMPLEX TO UNDERSTAND THE REAL ISSUE?

    WHO IS PMC SUPPORTING - THE BUILDER WHO HAVE BLATANTLY AND OPENLY CRUSHED ALL RULES OR THE CITIZENS?

PMC IS JUST NOT LISTENING & RESPONDING: PART 3

DEVELOPERS HAVE NOT LAID THE CONNECTING ROAD, PMC SAYS DEVELOPERS HAVE DONE IT WITHOUT VISITING ACTUAL SITE, HERE IS THE PROOF!

It is a common sense that Developers are duty bound to provide connecting road from their project site to the nearest PMC or PWD road. It is our understanding that it is mandatory for each Developer to comply with this requirement. 

When the completion certificate was provided to M/s. Palladium Properties, a joint venture between M/s. Shreyas Shelters and M/s. Raojee Constructions, PMC authorities did not verify if the connecting road has been laid by the Developers or not (SURPRISING ISN'T IT!).
We the residents have been approaching builder informally for several years now, with a request to fulfill this mandatory requirement. Developers did not pay any attention and neither took it seriously.
Frustrated with this attitude, we wrote several communications to the builders, which went UN-noticed. Finally, we wrote to PMC Commissioner (vide ref. no. PG-0070/2015 dated 7 September 2015). Relevant [related to connecting road] part of this 11-page long letter is appended below.
After a lot of perseverance, we received a response from City Engineer office, PMC [vide ref. no. Zone1/2002 dated 3 November 2015]. In its letter, PMC claims that;
"There is an access to PMC road from the project site, and all the buildings are accessible as well."

Now here is the ground zero situation as depicted in these photographs;


This view is from the PMC road towards the Palladium Grand Complex. This so-called connecting road is simply that of the rubble and soil. Is it a motorable connecting road? Can you call it a finished product? 


After this, we tried contacting the office of the City Engineer, PMC. There was no response of what so ever kind. 

We are shocked because of the non-responsive attitude of the PMC officers. Through this blogpost, we would like to ask Hon. Municipal Commissioner the following questions.
  1. Why PMC Officers are going to slow in pursuing this issue with the developer/builders?
  2. Why PMC is not blacklisting M/s. Palladium Properties, M/s. Raojee Constructions, M/s. Shreyas Shelters and M/s Shirish Dasnurkar for cheating PMC, and violating its mandatory compliance?
  3. How come PMC officers without verifying the facts on ground replied that Developers have indeed provided the connecting road?
Given our previous experience, we have no guarantee that PMC officers will indeed read this blog, or even respond. However, we are hopeful that the Chief Executive Officer i.e. Hon. PMC Commissioner will at some stage feel it essential to appropriate action in favor of the suffering citizens at the hands of the builders.

Connecting Road:
While sanctioning the plan proposed by the developers, the Office of the Dy. City Engineer (Development Plan) vide its commencement certificates nos. DPO/10396/H/75 dated 17 March 2006, DPO/4765/H/84 dated 11 Sept 2006 and DPO/8826/H/91 dated 18th January 2007 developers were mandated to provide connecting road [that connects the complex with the main DP road] of appropriate dimensions & quality. We are pained to inform you that such a connecting road is not built by the developers till date. As a consequence several minor and major accidents have happened, and the very life of the residents is always under threat.
a.    Did your officers or relevant department(s) was aware of this fact, that developers have not made connecting road that can cater to the entire Phase 1?
b.    How come your officer(s) or relevant department provided completion & occupancy certificate without ensuring that connecting roads are indeed provided by the developer?
c.    Given the above-mentioned circumstances, what action(s) would you propose to be taken against the defaulting developers who have clearly violated the spirit & specifications mentioned in the commencement certificates?
d.    What action(s) you would propose against the officers or the departments of the PMC which overlooked the compliance of the commencement certificate, and provided completion and occupancy certificate to the developers without ensuring that the specifications mentioned in the commencement certificates has been complied with in letter & spirit?
e.    What instructions or penalties or punitive measures you would impose upon the developers who have blatantly violated the directives of the commencement certificates for provision of connecting road?
f.     What plans and curative measures you would like to propose to ensure that the occupants are supplied with connecting road either by the developers or by the relevant PMC mechanism?
g.    How and what actions you and relevant departments will initiate to ensure that this facility is provided to the flat owners in immediate near future?
h.    How and what measures you and the relevant departments will initiate to compensate [or order developers to compensate] the flat owners for pain & trauma they have undergone for non provision of this facility which needs to be fulfilled according to the commencement certificates issued by relevant departments?

DEVELOPERS HAVE NOT INSTALLED SOLAR HEATING WATER SYSTEM

While providing commencement certificates for each stage of Palladium Grand complex located at Dhanori, Pune 411015; office of the City Engineer, Pune Municipal Corporation has mandated that developers must install "Solar Heating Water System". 

However, when the completion / occupation certificate was provided by the same office, it did not verify as to why "Solar Heating Water System" was not installed and commissioned by the developers M/s. Palladium Properties Ltd., a joint venture by M/s. Raojee Constructions and M/s. Shreyas Shelters.

We the residents have been approaching builder informally for several years now, with a request to commission this mandatory requirements as stipulated in the commencement certificates. Developers did not pay any attention and neither took it seriously.

Subject: WATER SUPPLY [Ref. letter from the Office of City Engineer (ref. no. Zone1/2002) dated 3rd November 2015] reg..

Dear Mr. Kumar,

At the outset let us express sincere thanks on behalf of the Palladium Grand residents for instructing and compelling the Office of the City Engineer to respond to our communication addressed to you (ref. PG-0070/2015 dated 7 September 2015).

In response to our query regarding the WATER SUPPLY to the Palladium Grand complex, the letter from the Office of the City Engineer, PMC state the following:

This matter comes under the preview of Water Supply Department. Thus, our communication has been forwarded to Bund Garden Water Supply Department vide letter ref. no. Zone1/1989 dated 2/11/2015.

1. We are sorry to inform you that Bund Garden Water Supply department has not taken any action in this regard. On the contrary, our oral enquiries are never honored and responded by the officers of the Bund Garden Water Supply department.

2. In the past, Water supply department has responded to us that supply of water is the internal matter between we the flat-owners and the builder/developer. This approach of your staff is thoroughly disappointing as well it can be considered as an in-direct attempt to deny us the right to live healthy and peaceful life.

3. We say this, because while submitting a proposal for this project, developers vide affidavit no. 6089 dated 9th November 2003 has given the undertaking that they as the developers are aware that PMC is not in a position to supply sufficient quantity of water. Thus, developers pledged that they would ensure the supply of good quality water either through bore wells or through water tankers at their own expense. However, till date residents have been paying for the restricted, inadequate and sub standard quality supply of water. We are pained to inform you that PMC supplied drinking water is not available to the residents since the so-called completion of Phase 1. Further, developers have discontinued bore well water supply and tanker water supply without any prior intimation.

4. In view of the above referred facts, we would like to enquire with you the following:

a. Why the officers of the Bund Garden Water Supply department did not initiate any action since November 2, 2015?
  1. Did your officers or relevant department(s) was aware of this fact, that developers have not made appropriate and adequate provisions for the supply of water that can cater to the entire Phase 1?
  2. How come your officer(s) or relevant department provided completion & occupancy certificate when the pledges sworn by the developers through above-mentioned affidavits were not fulfilled?
  3. Since, 2009 has your officer(s) or relevant department tried to ascertain whether pledges made by the builder through above mentioned affidavits have been fulfilled or not?
  4. In response to our letter PG-00020/2014 dated 30th November 2015 in connection with water supply, Bund Garden Water Supply office of the PMC vide its letter 1351 dated 19th December 2014 [copy enclosed] responded that this is an internal issue between the residents and the builder, and that we must resolve it ourselves.
  5. Such a response from the PMC is not only discouraging, but also in clear violation of its role as a monitoring and rules implementation authority.
  6. Given the above-mentioned circumstances, what action(s) would you propose to be taken against the defaulting developers who have clearly violated the pledge made through an affidavit?
  7. What action(s) you would propose against the officers or the departments of the PMC which overlooked the pledges of the affidavit, and provided completion and occupancy certificate to the developers without ensuring that the pledge has been complied with in letter & spirit?
  8. What instructions or penalties or punitive measures you would impose upon the developers who have blatantly violated the pledge for providing service of essential commodities such as water?
  9. What plans and curative measures you would like to propose to ensure that the occupants are supplied with adequate quantity of water either by the developers or by the relevant PMC mechanism?

  1. How and what actions you and relevant departments will initiate to ensure that this facility is provided to the flat owners in immediate near future?
  2. How and what measures you and the relevant departments will initiate to compensate [or order developers to compensate] to flat owners for pain & trauma they have undergone for non provision of this facility, which needs to be fulfilled according to the pledges made in above mentioned affidavits provided willfully by the developers?
Mr. Kumar, we are addressing this communication to you with a great sense of hope and admiration for your leadership, especially the initiative of Smart City that you are spearheading.

However, we are also addressing this communication with deep sense disappointment, feeling of being let down, as your office and the office of your concerned department has time and again ignored our pleas to take appropriate action. Further, you did not find it fit to respond to our earlier communication, but you simply forwarded the same to the Office of the City Engineer, who brushed aside answering the queries, and rather gave clinical answers.

This act of evasion clearly demonstrate the step-motherly attitude of the officers concerned or it hints of possible favoritism towards the developer/promoter M/s. Palladium Properties.

We the flat owners therefore request your intervention, as well prompt action. We would highly appreciate you visiting the complex at the earliest to take stalk of the situation personally.
